The Poverty of Ethics stands the usual moral-political dichotomy on its head. It argues that moral principles do not in fact underlie or inform political decisions. It is, rather, the conceptual primacy of political discourse that rescues ethics from its poverty. Our ethical convictions receive their substance from historical narratives, political analyses, empirical facts, literary-educational models, political activity and personal experience. Yet morality, essentially, doesn't leave room for relativity: not every ethos deserves to be titles 'moral'. Hence the book argues further, it is the left ethos, as it has evolved over years, which forms the basis for ethics: morality is left-wing! Clarifying and justifying this seemingly odd statement is the main purpose of this essay. Appealing to philosophical ideas on the essence of language, on meaning, on understanding and persuasion, this book scrutinizes the system of concepts and attitudes informing our common view of the relationship between the moral and the political. It argues that the traditional conception of morality is far too narrow to form a basis for political thought and political action. Its carefully unfolded argument concludes that none of the current philosophical accounts of morality can be translated into terms of political will, much less into direct political action. Being too general and elastic, neither abstract moral principles, ethical-aesthetic sensibilities, nor the ethical demand emanating from an Other, can fulfill these tasks. Instead, the false primacy of the ethical over the political and the infinite flexibility of vacuous moral discourse are often mobilized to launder wrongs and delegitimize radical left politics. Gratification of the moral high ground becomes an implement of de-politicization, and thus a powerful political instrument in the hands of those seeking to shore up the existing order.

The Rise of Mass Advertising is a first cultural legal history of advertising in Britain, tracing the rise of mass advertising c.1840-1914 and its legal shaping. The emergence of this new system disrupted the perceived foundations of modernity. The idea that culture was organized by identifiable fields of knowledge, experience, and authority came under strain as advertisers claimed to share values with the era's most prominent fields, including news, art, science, and religiously inflected morality. While cultural boundaries grew blurry, the assumption that the world was becoming progressively disenchanted was undermined, as enchanted experiences multiplied with the transformation of everyday environments by advertising. Magical thinking, a dwelling in mysteries, searches for transfiguration, affective connection between humans and things, and powerful fantasy disrupted assumptions that the capitalist economy was a victory of reason. The Rise of Mass Advertising examines how contemporaries came to terms with the disruptive impact by mobilizing legal processes, powers, and concepts. Law was implicated in performing boundary work that preserved the modern sense of field distinctions. Advertising's cultural meanings and its organization were shaped dialectically vis-à-vis other fields in a process that mainstreamed and legitimized it with legal means, but also construed it as an inferior simulation of the values of a progressive modernity, exhibiting epistemological shortfalls and aesthetic compromises that marked it apart from adjacent fields. The dual treatment meanwhile disavowed the central role of enchantment, in what amounted to a normative enterprise of disenchantment. One of the ironies of this enterprise was that it ultimately drove professional advertisers to embrace enchantment as their peculiar expertise. The analysis draws on an extensive archive that bridges disciplinary divides. It offers a novel methodological approach to the study of advertising, which brings together the history of capitalism, the history of knowledge, and the history of modern disenchantment, and yields a new account of advertising's significance for modernity.

Many people who work in education start out with enthusiastic ideals about education as a positive force that can spur change in the life of the learner and in society at large, yet find themselves frustrated with a bureaucratic system that often alienates and excludes many of its students. This is particularly true for students identified as having "special educational needs" (SEN) or disability, a label often used to justify the ways in which students are failed by a system that focuses on narrow definitions of knowledge, seeks to normalise and control behaviour, and values economic productivity over other forms of human activity. Radical Inclusive Education explores how current educational practices, such as standardised tests and league tables, exclude and fail many disabled students, and naturalise educational inequalities around gender, class, ethnicity and ability. Informed by the social model of disability, the book argues that educational theories and practices that are geared towards social justice and inclusion need to recognise and value the diversity of human embodiments, needs and capacities, and foster pedagogical practices that support relations of interdependency. The book draws on work in disability studies, critical psychology and critical pedagogy, and also real life examples from interviews with activists in the disabled people’s movement, and from research in a school, to offer examples of what radical inclusive education – that is sensitive to the needs of all students – might look like in practice. This book analyses the right to religious freedom in international law, drawing on an array of national and international cases. Taking a rigorous approach to the right to religious freedom, Anat Scolnicov argues that the interpretation and application of religious freedom must be understood as a conflict between individual and group claims of rights, and that although some states, based on their respective histories, religions, and cultures, protect the group over the individual, only an individualistic approach of international law is a coherent way of protecting religious freedom. Analysing legal structures in a variety of both Western and Non-Western jurisdictions, the book sets out a topography of different constitutional structures of religions within states and evaluates their compliance with international human rights law. The book also considers the position of women's religious freedom vis-à-vis community claims of religious freedom, of children’s right to religious freedom and of the rights of dissenters within religious groups.
In Liberalizing Contracts Anat Rosenberg examines nineteenth-century liberal thought in England, as developed through, and as it developed, the concept of contract, understood as the formal legal category of binding agreement, and the relations and human practices at which it gestured, most basically that of promise, most broadly the capitalist market order. She does so by placing canonical realist novels in conversation with legal-historical knowledge about Victorian contracts. Rosenberg argues that current understandings of the liberal effort in contracts need reconstructing from both ends of Henry Maine's famed aphorism, which described a historical progress "from status to contract." On the side of contract, historical accounts of its liberal content have been oscillating between atomism and social-collective approaches, missing out on forms of relationality in Victorian liberal conceptualizations of contracts which the book establishes in their complexity, richness, and wavering appeal. On the side of status, the expectation of a move "from status" has led to a split along the liberal/radical fault line among those assessing liberalism's historical commitment to promote mobility and equality. The split misses out on the possibility that liberalism functioned as a historical reinterpretation of statuses – particularly gender and class – rather than either an effort of their elimination or preservation. As Rosenberg shows, that reinterpretation effectively secured, yet also altered, gender and class hierarchies. There is no teleology to such an account.
Modernism can be characterised by the acute attention it gives to language, to its potential and its limitations. Philosophers, artists and literary critics working in the first third of the twentieth century emphasized language’s creative potential, but also stressed its inability to express meaning completely and accurately. In particular, modernists shared the belief that the kind of truth sub specie aeterni that was sought by philosophers was either meaningless or was more appropriately expressed by the arts – especially by literature and poetry. Modernism and the Language of Philosophy addresses the challenge this belief presented to philosophy, and argues that the modernist assumption rests upon a host of unacknowledged, repressed or denied dogmas or tacit images. Drawing in particular upon the work of Michale Dummett and Jacques Derrida, this book explores a new solution to this crisis in philosophical language, and it is these two philosophers who drive the narrative of the book and offer perspectives through which both past and present day philosophers are examined.
