This bookexamines liberty’s Constitutional meaning through the jurisprudence of Justice Stephen Field, one of the late-Nineteenth Century’s most influential Supreme Court Justices. A Lincoln appointee who served on the Court from 1863-1897, Field articulated a view of Constitutional liberty that speaks to contemporary disputes. Today, some see liberty as protection through government regulation against private oppression. Others see liberty as protection from government through limits on governmental power. Justice Field is often viewed as siding against government power to regulate, acting as a pre-cursor to the infamous “Lochner”Era of the Court. This work explains how Field instead saw both these competing conceptions of liberty as legitimate. In fact, the two cooperated toward a common end. In his opinions, Field argued that protections through and from government worked in tandem to guard fundamental individual rights. In describing this view of liberty, Field addressed key Constitutional provisions that remain a source of debate, including some of the earliest interpretations of the Due Process Clause, its relationship to state police power and civil rights, and some of the earliest assertions of a national police power through the Commerce Clause. This work furthermore addresses the underpinnings of Field’s views, namely that he grounded his reading of the Constitution in the context of the common law and the Declaration of Independence. In his principles as well as his approach, this book argues, Justice Field presents a helpful discussant in ongoing debates regarding the meaning of liberty and of the Constitution.

Cardiovascular drug therapy has markedly progressed in the recent decades. Not only have new drugs been introduced to clinical practice, but new classes of drugs have been developed. While in 1960 the practicing cardiolo gist had a selection of about only ten drugs, in 1987 about 150 drugs are routinely used in cardiovascular diseases. Elderly patients, however, usually do not enjoy the full benefit of this progress. This might be due to lack of knowledge, a conservative approach, or the worldwide tendency not to try new drugs in the elderly. It is now clear that the majority of patients that will be treated in car diovascular clinics will be, in the near future, elderly patients. Even now, elderly patients form about one-third of the patients with cardiovascular diseases. These patients are approached, however, according to criteria devel oped for younger populations. This is despite the fact that elderly patients differ from younger ones in most aspects, including pathology, epidemiol ogy, pathophysiology, diagnostic approach, management, pharmacology, pharmacokinetics, rehabilitation, and supportive treatment. It is the purpose of this book to present to the clinician all drugs with which there is clinical experience in the elderly or which might be potentially useful for the elderly with cardiovascular diseases. Although supporters claim that open access is pro-competitive, the opposite is true. Forced access policies inevitably mean price and quality controls, stagnation, increased litigation, and a crippling of innovation. Genuine competition requires that firms have the ability to exclude rivals. Government seizure of existing networks and technologies on behalf of rivals means that next-generation technologies will not be created by those rivals or the incumbents. The recent decision by the FCC to continue such micro-management of local telecom markets illustrates this principle; regulators have opted to continue to require sharing of local telephone lines and switches despite the fact that those rules have decimated innovation and investment in the U.S. telecom market. The key message for policymakers hoping for a high-tech renaissance: Competition in the creation of networks is as important as competition in the goods and services that get sold across those networks. Competition, innovation, and consumers will suffer if forced sharing policies are not abandoned. In today's world of increasing global communications and digital technologies, What's Yours Is Mine makes an urgently needed pro-consumer case for laissez-faire in the evolution of technology industries.

The conflicted allegiances with respect to traditions, disciplines, divisions, stakes, and stakeholders represent the structural and historical situation of the field, as it comes into contact with the humanities more broadly. At once a literary and philosophical thinker, Newton deploys a tableau of texts in concert with an ensemble of vivid, elastic tropes not only to theorize Jewish Studies but also to reimagine it as an agent of that potency Jacques Derrida calls “leverage”—a force multiplier for the field’s multiple possibilities. In refiguring a Jewish Studies to come, the book intervenes in a broader discourse about the challenge of professing disciplinary knowledges while promoting transit across their boundaries. This Best Practice Guide on the Control of Iron and Manganese in Water Supply is one of a series produced by the International Water Association’s Specialist Group on Metals and Related Substances in Drinking Water. Iron and manganese are often found in soft upland water sources associated with natural organic matter and are also commonly found in the groundwater abstracted from confined and unconfined aquifers. The presence of iron and manganese in water is one of the most frequent reasons for customers’ complaint due to aesthetic issues (yellow, brown and black or stains on laundry and plumbing fixtures). These two metals can be removed fairly readily by physico-chemical treatment. The municipal treatment systems deployed derive benefit from their larger scale, particularly in relation to control, but the processes used are less suitable for the numerous small supplies that are the most common water supplies throughout Europe, especially in rural areas. One important source of iron in drinking water is from old corroded cast-iron water mains, historically the material used most commonly in supply networks. Replacement and refurbishment is very expensive and the major challenge is how best to prioritize available expenditure. The purpose for this Best Practice Guide on the Control of Iron and Manganese in Water Supply is to give readers the broad view of a problem based on state-of-the-art compilation of the range of scientific, engineering, regulatory and operational issues concerned with the control of iron and manganese in drinking water.
