The Political Economy of American Warfare, 1945–2011

In his farewell speech, President Dwight Eisenhower famously warned us of the dangers of a military-industrial complex (MIC). In Paul Koistinen's sobering new book, that warning appears to have been both prophetic and largely ignored. As the final volume in his magisterial study of the political economy of American warfare, State of War describes the bipolar world that developed from the rivalry between the U.S. and USSR, showing how seventy years of defense spending have bred a monster that has sunk its claws into the very fabric of American life. Koistinen underscores how during the second half of the twentieth century and well into the twenty-first, the United States for the first time in its history began to maintain large military structures during peacetime. Many factors led to that result: the American economy stood practically alone in a war-ravaged world; the federal government, especially executive authority, was at the pinnacle of its powers; the military accumulated unprecedented influence over national security; and weaponry became much more sophisticated following World War II. Koistinen describes how the rise of the MIC was preceded by a gradual process of institutional adaptation and then supported and reinforced by the willing participation of Big Science and its industrial partners, the broader academic world, and a proliferation of think tanks. He also evaluates the effects of ongoing defense budgets within the context of the nation's economy since the 1950s. Over time, the MIC effectively blocked efforts to reduce expenditures, control the arms race, improve relations with adversaries, or adopt more enlightened policies toward the developing world-all the while manipulating the public on behalf of national security to sustain the warfare state. Now twenty years after the Soviet Union's demise, defense budgets are higher than at any time during the Cold War. As Koistinen observes, more than six decades of militaristic mobilization for stabilizing a turbulent world have firmly entrenched the state of war as a state of mind for our nation. Collectively, his five-volume opus provides an unparalleled analysis of the economics of America's wars from the colonial period to the present, illuminating its impact upon the nation's military campaigns, foreign policy, and domestic life.

The Irish revolution of 1916-23 is generally regarded as a success. It was a disastrous failure, however, for the Catholic and nationalist minority in what became Northern Ireland. It resulted in partition, a discriminatory majoritarian regime and, more recently, a generation of renewed violence and a decade of political impasse. It is often suggested that the blame for this outcome rests not only on 'perfidious Albion' and the 'bigotry' of Ulster Unionism but also on the constitutional nationalist leaders, John Redmond, John Dillon and Joe Devlin. This book argues that, on the contrary, the era of violence provoked by Sinn Féin's 1918 general election victory was the primary cause of partition so far as actions on the nationalist side were concerned. Hepburn also suggests that the exclusively Catholic Ancient Order of Hibernians was in fact less sectarian than Sinn Féin, and that Devlin's practical contribution to the improvement of working-class conditions was more substantial than that of his republican socialist contemporaries. Too much Irish history has been written from the standpoint of the winners. This book, as well as detailing the life of an important but neglected individual in the context of a social history of Catholic Belfast, offers a general re-interpretation of Irish political history between the 1890s and the 1930s from the perspective of the losers.

A History of Securities Law and the Supreme Court explores how the Supreme Court has made (and remade) securities law. It covers the history of the federal securities laws from their inception during the Great Depression, relying on the justices' conference notes, internal memoranda, and correspondence to shed light on how they came to their decisions and drafted their opinions. That history can be divided into five periods that parallel and illustrate key trends of the Court's jurisprudence more generally. The first saw the administration of Franklin Delano Roosevelt--aided by his filling eight seats on the Court-triumph in its efforts to enact the securities laws and establish their constitutional legitimacy. This brought an end to the Court's long-standing hostility to the regulation of business. The arrival of Roosevelt's justices, all committed to social control of finance, ushered in an era of deference to the SEC's expertise that lasted through the 1940s and 1950s. The 1960s brought an era of judicial activism-and further expansion--by the Warren Court, with purpose taking precedence over text in statutory interpretation. The arrival of Lewis F. Powell, Jr. in 1972 brought a sharp reversal. Powell's leadership of the Court in securities law produced a counter-revolution in the field and an end to the SEC's long winning streak at the Court. Powell's retirement in 1987 marked the beginning of the final period of this study. In the absence of ideological consensus or strong leadership, the Court's securities jurisprudence meandered, taking a random walk between expansive and restrictive decisions.
